I think this might be a first. I installed fresh copy of CB 3.1 and everything installed. It came back to the plugin screen and I noticed that it was waiting for the update from 3.0. I tested it out after the upgrade and worked fine. Then I went to the admin CB config and made a change from static to iframe and saved it off. Then I got this msg.

So then I looked in that file and found this...

Any idea why that happened? Seems like is not saving the info from the config menu. I even tried to manually edit and save the file. It allowed me to get back into the site and the CB worked, however, going back and making any changes on the config in the admin menu, resulted in the same error after saving it off. And yes...it does have Read/Write/Modify access to that file.

I see that the plugin version field is not updated on the initial install but get no errors when I execute the update.

Correct. I got the same thing. It was the other that I had mentioned above that gave the error after the fact.

Uh, found the issue when Register_Globals is off.

Update to admin/plugins/chatterblock/index.php at the top - replace this section of code with the code below
